Is there any rule under the R.T.I. Act wherein an appellant is barred under the maximum number of 2nd appeals, fixed by the Central or the State Information Commission? Can the Information Commission (State/Central) decide to close such 2nd appeals based only on the number of 2nd appeals without hearing the merits of all the 2nd appeals ? Because West Bengal State Information Commission has served such notice of closure of 2nd appeals filed. Legal advice is urgently required

There is no stipulation under the RTI Act that limits a citizen from filing second appeals. All appeals filed by a citizen need to be heard on it's merit by the appellate authority or the information commissioner as the case may be. If you find that your appeals have been disposed off without a proper hearing, you can approach the either approach the chief information commissioner or the department of personnel and training (DOPT) which is the nodal agency for RTI, requesting intervention. Alternatively, you can also file a writ petition in the high court on the grounds that the SIC's actions are arbitrary, unreasonable and without authority of law.
