Before the final extension of the deadline to link PAN and Aadhaar number, the govt limited the consequences of not linking. Most importantly, they removed the provision which denied an inoperative pan from being furnished/quoted. Recently, a bank has deleted my PAN and is refusing to accept it again until it is made operative. A written complaint only elicited a response stating govt guidelines with no mention of anything specific. Is RBI Ombudsman worth pursuing or will they also side with the bank citing govt mandate without understanding the actual law? Clearly the govt did not want to prohibit inoperative PANs from being used. How do I use RTI to get information from the govt on the reason for limiting the consequences of inoperative PAN?

Dear Mr Niraadhaar

Financial institutions, banks and other regulated entities access data related to PAN, including its status, through authorized portals such as the Income Tax e?Filing portal, Protean eGov (formerly NSDL eGov), and UTIITSL.  So, instead of lodging complaint with the bank or with RBI Ombudsman, you have to contact your Income Tax Officer under whose jurisdiction you fall.  He will explain the reason why PAN status is INACTIVE.  If possible, carry with you a letter or screenshot from your bank showing the status of your PAN.

The possibility is that one of the above websites, whose services are availed by your bank, might not have fetched and updated PAN record; and the same status is being shown on the bank’s screen.  If you are facing any difficulty, you may approach your chartered accountant to help you out.
