In our Coop Housing Society we have about 250 flats varying from 2 BHK to Penthouse , 6 row houses and also a shopping center with 25 shops of sizes 150-250 sq ft, which is inside the society gate and not at the boundary walls. The society is enclosed by a boundary and all access is through the main gate. Now all the flats and row house maintenance dues are unit wise for last 20 years but the shops are paying maintenance by square feet. A number of the Managing committee consist of the shop owners who are also owners of the flats in the society. Now maintenance dues as per the rules should be unit wise for them too. (The shops have no lift as it is only consists of basement and 2ground plus 1 floor). The shops share the same gardens, Housekeeping, Office staff, common road, water and common lights, as all other flat and row house owners as they are all society members. Now should the shop owners who are also members of the society also pay the same maintenance, for all these common services?.

Dear Mr Mathew,

All flats, row houses and shop keepers should pay same society's maintenance, irrespective of the area of flat/shop/row-house, under Bye-laws 65(g) and 66.
  
Only following items, one has to pay as per area of flat/shop/row-house under the Bye-law No. 67(a) 
(i) Property Tax,, as calculated by local Municipality.
 
(ii) Water Charges, by the Society, on number of taps 
       and size of the taps.
 
(iii) Expenses on repair and maintenance of the building/s
       of the Society, subject to a minimum 0.75% of
       construction cost of the flat per year, to be collected
        proportionately monthly.
 
(v) Sinking Fund, subject to a minimum 025% construction
       cost of the flat per year, to be collected
        proportionately monthly
 
(xi) Insurance Charges.
 
(xii) Lease Rent of Society's land, if land is on Lease.
 
(xiii) Non-Agricultural Tax.
