Can sole owner in his lifetime make a Release Deed/Family arrangement for future when he is dead ,in name of his Daughter,s son so in future no problems are created by Society to transfer flat in his name. In such case what papers should be given to society? Present nomination is in daughter`s name. Also water charges as per no. of connections but IF Members of mg. com. use Pressure Pumps (ILLEGAL)due to which higher floors donot get water. What can be done? Reporting to BMC does not helps as when THEY VISIT Hon Sec etc give them some big names of BMC & they go away without any action.
Dear Ashok, You have two problems, the solution to each of the problem is as under, (1) To get your ownership lat after your death, you will make a Sub-Registrar of Assurances registered Will. After your death, your will in Testamentary Division of the Bombya High Court it will be Probated, and then your flat is transferred in the name of a person, stated by you in your will. Your will has to be done on a plane paper, it should be witnessed by two adult persons as witnesses. To transfer your flat easily, kindly make your daughter's son as the nominee of your flat instead of your daughter. (2) If some one has put pressure pump in your building to his pump inside his flat, then Bye-law No 174(D)(ii) make a complaint against sucha flat owner to your local BMC Ward's Assistant Municipal Commissioner. He will refer your complaint to water works department, who will visit his house, remove the forced water pump and levy fine to him.
