Our society in Charkop Mumbai was allotted land by MAHADA under world Bank Project on which we constructed a 5 story Building. The lease agreement was between Society and MAHADA No Individual agreement with flat owners. One member defaulted in payment during construction period and there after never paid any amount she does not even took the possession . Now she has requested NOC to sell the flat . There is an apprehension among the members that Erring member has already entered in to sale agreement with innocent buyers. The society is not aware of this transaction Now how to confirm that the erring member has not sold the flat to some body Before giving NOC society wants to ascertain that she has not sold the flat .
Before you give NOC to defaulter member, society will give in two news paper advertisement, that flat No. x of member y, who has defaulted in z payment with interest, want to sell her flat. If any one has any objection, within 15 days of publication of the letter should contact in writing or by email (Give postal address, and email ID, of your society, in this advertisement.) within 15 days of publication of this notice. If objection is not received within 15 days of this notice, then Society will give allow the flat owner to sell the flat, and buyer will pay z amount from the consideration of member y's flat, before buyer entering into a Sale Deed of said flat with owner y. .
