The possession was delayed from original 2015 date but as it went to insolvency Jaypee sent a possession letter hastily of incomplete and totally unfinished project.It was just a farm land instead of fully developed plot site with clubs , boulevard etc promised.
They started calculating delayed payment interest on that and sent just one Satement.Now the company is in NCLT the new bidders are not offering any money for refund to people like us as they say we have been offered possession.
You have a wrong proof that you are given a possession of your developed plot by Jaypee Builder.
When you booked your bungalow plot, there must be some letter giving you the possession of bungalow plot with all facilities, such as club house, boulevard, etc.
Even plots without making them Non-agricultural, with separate survey number and plot area is given, then your project is highly incomplete.
With all available proofs from your offer letter given to you when you paid your first installment to buy the plot, you make complaint to NCLT, with all proof from Land Revenue Department.
With reference to possession letter, if your plot, you ask NCLT, to check from plan passing authority of said project, whether your your plot is completed as stated in the possession letter given to you by the defunct builder Jaypee.
NCLT was made to protect the interest of investors and not to harass the customers of defunct builder Jaypee.
If new builder serves you the notice to pay remaining payment without completion of the project, just because defunct builder has given you possession letter of incompletely developed plots, then make complaint against new builder, by making NCLT and Jaypee builder as party, with State Consumer Forum.
State Consumer Forum complaint has to be made by each and every individual plot buyer of defunct Japyee builder.
