Dear Sir/ Madam I would like your opinion on issue concerning related to redevelopment of Cooperative Society in your podcast on July 29th and through mail if I miss the podcast. I am owner of a small Flat in Maharashtra which has undergone redevelopment as the same had become unlivable due to wear and tear .Now after completion on fresh registration the builder is demanding GST to be paid on construction service rendered. My query is 1. Are we suppose to pay GST as no consideration has moved from our side except we received 15% more space as compared to our old area. 2.If at all we are liable to pay, then the question arises on what amount we are suppose to pay. Is it fair value of similar property or stamp duty value of the property. 3. As per GST norms property with value less than 45 lakhs the GST rate is 1% and value above that it is 5%. In our society some of the flats are value above Rs.45 lakhs and some are valued less than that. This valuation is the s stamp duty value of the property. It will be very helpful if the expert on your panel can provide guidance on this issue as their we are getting multiple advices on the above subject. Thanking you, VILAS M. Dear Mr Gala,

GST is not applicable to original members, who get at least 35%  of its original flat's carpet area free of charge, in new flat, after redevelopment.
