Dear Sir,

I have following queries about RTI implementation in our company.

Our Company named as NHPTL (National high power test laboratory India Pvt. limited) has been formed on the initiative of Ministry of Power, a Joint Venture Company of NTPC, NHPC, POWERGRID, DVC & CPRI was formed on 22.05.2009. it is a joint venture company of 3 PSU & two government own bodies and registered as private company act 1956.
Details of company promoters: NTPC (Indian Government PSU), NHPC (Indian Government PSU), (Indian Government PSU), Powergrid (Indian Government PSU), DVC (Indian Government firm, formed by parliament Act) and CPRI. These promotors has provided equity to company & rest is loan taken From PFC for the project at Bina , Sagar M.P. This company has more than 75% equity indirectly belongs to Government of India.
Recently there are few RTIs filled against this company to know information about NHPTL Finance related mismanagement. But this RTI was decline as saying that it is private company. On the initiative of last Chairman during the board of director meeting held in April month 2017, RTI implement resolution was passed and RTI act was made applicable to this company.Hence this company comes under RTI. But in the month of September 2017, new chairman comes and in an another board of meeting held in September month 2017 , the Board passed the resolution to make RTI non applicable to our company citing the reason that NHPTL is a private company & reversed the RTI Implementation in our company.
I have following queries in this whole issue.
1. Is RTI Act applicable to our company since 75% of equity indirectly belongs to Govt. of India?
2. Is there any violation of RTI Act or Violation of any court order or any another law when decision to Implementation RTI act in Our company is reversed in board meeting.
Please guide/answer me above query no1 & 2issues.
1. If 75% of the financing is by government, NHTPL is a public authority subject to the RTI Act.
