Our CHS convened a general meeting and placed before Members a resolution to Expel a member from the membership of the Society. The reasons cited were that she - caused hindrance, obstruction, contrary to the interests of the Society and against larger good. - Attempted to disrupt and/or cause annoyance to members at numerous general meetings and intentionally attempted to dislodge will of Members - Responsibly indulges in making frivolous complaints and causing repeated obstructions in functioning of Society activities - Repeated violations and failure to adhere to directions of the MC The voting was by secret ballot. The Returning Officer announced at the meeting the no. of Members who voted: FOR ” the resolution, the no. of members who voted: AGAINST the resolution and the no. of INVALID ballots (i.e. blank ballots) . CHS, however, recorded in the Minutes the no of votes FOR and AGAINST and by disregarding the INVALID ballots got the desired 75% to pass the resolution. The said resolution was approved by the Dy. Reg. and immediately thereafter the Member was expelled from the Society. All rights of the member were withdrawn, all services (garbage collection, etc.) suspended and all communications (circulars, minutes, notices) were suspended, causing immense harassment and mental torture to the expelled Member. The Member, if unsatisfied with the verdict of the Dy. Reg. has a right to approach the Joint Reg. and if still unsatisfied has the right to file a say before the Minister of Co-op. and if still unsatisfied approach the High Court. Before permitting the Member to exhaust all the legal options under law, the Member has been expelled. It is an established practice that if a person is convicted to a jail term by a lower court, he is not immediately put injail, but is given time and opportunity to appeal to the Higher court/s and only when the final court gives the judgment is the jail term executed. a) Is the CHS within its rights to expel the Member when all legal options are not fully exercised by her? b) What remedy do you suggest?  CHS, property-related issues
