I have purchased a flat in 2015. Builder name is Marvel lifespaces in vashi. At the time of booking of flat, I was told flat will be handed over in 1 year. In the flat documents he has mentioned registration date as 30.06.2019 plus 6 months grace period twice.
we have complaint in rera and the hearing date is next month (January 2020).
Its a four storey building and builder has only completed up to first floor. After that for last 2 1/2 years, the construction has been stopped.
we around 15 members have put complaint against the builder . Builder was given to us in writing in his letter head that he will start paying rent if there is delay, but he is not paying us rent. We have mentioned everything in the letter addressed to Rera and asked for compensation as some members are paying extra emi, bank compound interest because of this delay.
In Rere he has put completion date as 30.06.2021 without our consent. When we booked the flat in 2015, that time Rera was not formed.
Since builder has entered with you, a fixed date 30.6.2019, with six months grace period, 31.12.2019 is final date, in your Sub-Registrar's Office Registered Sale Deed.
Even if he puts some other date much ahead of registered date in MahaRERA registration of your under construction project, it was made without your written consent.
Therefore, when you go for hearing with MahaRERA, you go there with picture (photos) of your building, showing that building has completed only one floor, for 4 storied building, and ask for commitment of rent for alternate temporary accommodation, till Building Completion Certificate to the under construction building is obtained.
You will also say that although builder has agreed in registered sale deed of your agreement to give you the flat by 31.12.2019, with six months grace period, without buyer's consent he has put 30.6.2021 as building completion date in MahaRERA registration of your project.
MahaRERA Officer who will give hearing to you, flat buyers and the builder, and he will pass order to pay you rent till 30.6.2021.
You will ask MahaRERA Officer to pass the order to pay predated cheques for all months till June, 2021 to all the flat buyers.
Ask in the hearing, that Builder should make his financial position clear to MahaRERA officer in the hearing, and show the evidence to that effect to you, all in writing. Otherwise, MahaRERA will pass the order, and then you will find that builder is broke, and you will not get
