A member of our Society expired a few years ago.She has a Son and daughter. The son is presently staying in the flat with his wife and a son. The deceased member had made a will (unregistered) in favour of daughter in law. As there is some internal family matter the son of deceased member is unable to get any document or release Deed etc from his sister to transfer the flat in his or his wife s name. Society has written a letter to the son who is residing in the flat to submit documents for transfer , but no action is being taken by him. The society bills which are in name of deceased member are being paid by the son residing in the flat. What steps can Society take to solve the problem in this case.
Dear Sir / Ma'am Ask the expired flat owner's son to make a Testamentary Petition in a competent court of law, to get the flat transferred in his name.
