West Asia Conflict: MahaRERA Grants 4-Month Extension to Eligible Housing Projects

The extension will apply to registered projects whose completion date, revised completion date or extended completion date falls on or after 28 February 2026. The relief will be granted automatically, and promoters will not have to file separate applications, the Authority said in an order issued on Friday.
 
However, projects registered on or after 1 August 2026 will not be eligible for the four-month extension.
 
The MahaRERA order, issued under Sections 6 and 37 of the RERA Act, follows an advisory issued by the Union Ministry of Housing and Urban Affairs on 31 July 2026, asking real estate regulatory authorities (RERAs) across the country to issue suitable common orders extending registration and corresponding completion timelines by four months for eligible projects affected by the situation in West Asia.
 
The order has come into force with immediate effect.
 
MahaRERA's decision follows the Union Ministry of Finance's (MoF's) office memorandum (OM) issued on 29 April 2026, under which the prevailing situation in West Asia was treated as a 'War' for the purpose of invoking force majeure.
 
Section 6 of the RERA Act empowers the regulatory authority to extend the registration of a real estate project in the event of force majeure. The provision recognises circumstances beyond the control of the promoter that can affect the timely completion of a project.
 
The Union Ministry of Housing and Urban Affairs subsequently advised all RERAs to provide a common four-month extension instead of requiring individual promoters to approach the authorities with separate applications.
 
The move is aimed at providing regulatory relief to projects facing delays because of disruptions linked to the conflict.
 
Under the MahaRERA order, all registered projects with a completion date, revised completion date or extended completion date falling on or after 28 February 2026 will receive a four-month extension.
 
For example, a project whose applicable completion date falls within the eligible period will get an additional four months under the order without the promoter having to submit an individual request to MahaRERA.
 
The automatic extension is intended to avoid a project-by-project application process and provide uniform relief to eligible developments across Maharashtra.
 
Projects registered from 1 August 2026 onwards have specifically been excluded from the extension.
 
The order directs MahaRERA's registration and IT cell to make the necessary changes to the Authority's records and web portal to reflect the revised timelines.
 
This means the extended completion dates will be incorporated into the regulator's records without requiring promoters to separately approach the Authority for the four-month extension.
 
The decision is expected to provide relief to developers dealing with disruptions that may affect construction schedules, project execution and completion timelines.
 
The RERA framework allows the registration period of a real estate project to be extended in circumstances covered by force majeure. The provision is intended to address extraordinary events beyond the control of project promoters that prevent or materially affect timely completion.
 
By treating the prevailing situation in West Asia as 'War' for the purpose of force majeure, the government created the basis for regulatory authorities to consider the impact of the conflict on project timelines.
 
The order provides developers with additional time to complete eligible projects while avoiding the need for individual extension applications, thereby creating a uniform mechanism for projects covered by the force majeure relief.
