Buying extra floor space index or paying a penalty cannot be a way to regularise an unauthorised construction, the Bombay High Court has ruled. Justice Roshan Dalvi upheld an order vacating the stay on the demolition of the top two floors of Shubh Apartments. “Purchase of the FSI cannot legalise such unauthorised construction,” said the judge.
