The Delhi High Court has granted an interim injunction in a commercial suit filed by SNV Aviation Private Limited, the operator of Akasa Air, to restrain multiple entities from allegedly impersonating the airline and using its trademarks to run recruitment-related scams [SNV Aviation Vs Alaska Aviation Academy].
Justice Manmeet Pritam Singh Arora passed the interim order on a suit by SNV Aviation filed against various entities, seeking permanent injunction, damages, rendition of accounts, and ancillary reliefs for trademark infringement, passing off, and unfair competition.
"The Court, upon consideration of the material on record, is of the opinion that a prima facie case is made out in favour of the Plaintiff (SNV Aviation/ Akasa Air). The acts of the infringing Defendants in approaching unwary members of the public, falsely representing that they are offering employment on behalf of the Plaintiff, and demanding 'process fees' for such employment, when the Plaintiff admittedly follows no such practice clearly amounts to misrepresentation, deception, and passing off," the Court said.
Akasa Air alleged that the defendants contacted members of the public through telephone calls and emails, falsely representing themselves as agents or employees of the company and offering employment opportunities. The airline stated that the defendants demanded payment of “process fees” under the false pretext of recruitment.
Akasa Air claimed that these entities unauthorisedly used its registered trademarks, including “AKASA” and “AKASA AIR”, as well as deceptively similar marks such as “AKASHA” and “AKAASA”, and registered infringing domain names to mislead job seekers into believing that the communications originated from the airline.
The airline further stated that it had received multiple complaints from members of the public regarding such communications and that these activities caused serious reputational harm, loss of goodwill, and erosion of public trust in its brand.
On December 22, the Court restrained various entities (defendants 1 to 18 in the suit) from using Akasa Air’s trademarks or any identical or deceptively similar marks in any manner, including through domain names, email addresses, or recruitment communications.
The Court also directed:
- The suspension and locking of specified domain names by the concerned registrars. The URLs ordered to be blocked include https://hrakasaair.com, http://akaasaservices.com, http://akasaairltd.com/, and http://akasaairltd.com/.
- The disclosure of KYC details and blocking of mobile numbers belonging to the alleged impersonators named as defendants in the suit. The Union Ministry of Electronics, Information, and Technology (MEITY) and the Department of Telecommunications have been directed to issue instructions for the same to telecom service providers.
- Disclosure of KYC details and blocking of specified UPI IDs associated with the alleged impersonators, as well as their bank accounts.
The matter has been listed before the Joint Registrar on February 3, 2026, and before the Court on May 22, 2026.
