Delhi HC Asks I-T Dept to Refund Rs72 Crore to Tata Teleservices within 4 Weeks

The Delhi High Court (HC) has asked the income-tax (I-T) department to refund within four weeks Rs72 crore to Tata Teleservices Ltd. 
In an order issued on 17 January 2022, the division bench of justice Manmohan and justice Navin Chawla says, "Prima facie, it appears that there is no justification for the respondents (I-T department) in not granting the refund when the same is due. We, therefore, direct the respondents to refund the amount for the assessment year 2020-21 along with interest as applicable to the petitioners within four weeks."
Denying any additional time to the tax authorities, the bench further says, "In case, the respondents have any valid justification for withholding the refund, or any part thereof, they shall file their counter-affidavits positively within the same period clearly stating as to why the refund or partial refund is not due. It is made clear that no further time shall be granted to the respondents for the said purpose."
Tata Teleservices has approached the HC seeking a refund of Rs72.23 crore as determined by the I-T department under section 143 (1) of the I-T Act for the assessment year 2020-21. (WP (C) 1044/2022)
The next hearing, in this case, is scheduled for 7 April 2022.
