Court asks Centre to file docs on land allotted to DIAL in two weeks

As per the petition, the government had given away 190 acres of prime land and assets to GMR-controlled DIAL at a throw-away price of Rs3.25 lakh per acre against the market price of Rs100 crore per acre.

 
New Delhi: The Centre was on Wednesday granted two weeks more to submit to the Delhi High Court the documents relating to the alleged allotment of 190 acres of IGI Airport land to private consortium Delhi International Airport (P) Ltd (DIAL) at a 'throw-away' price, reports PTI.
 
A bench of Chief Justice D Murugesan and Justice Rajiv Sahai Endlaw granted time to the government after Additional Solicitor General AS Chandhiok said the matter has been referred to a parliamentary panel as the Comptroller and Auditor General (CAG) audited the land allotment and said huge loss has been caused to the exchequer.
 
"The matter is pending before a parliamentary committee, which is looking into the issue," said the ASG, while seeking more time to file the documents.
 
The court was hearing a petition filed by NGO Youth Against Corruption, which has sought a thorough probe into the IGI Airport land allotment to DIAL.
 
Petitioner counsel MN Krishnamani pleaded with the court against disposing the matter saying "the parliamentary panel cannot consider the criminal aspect of the issue which is to be dealt with by the CBI for which the court can pass an order." 
 
The bench earlier had sought the government's explanation to the allegation in the petition, filed through counsel Vikramjit Banerjee and Saurav Shamsherry.
 
As per the petition, the government had given away 190 acres of prime land and assets to DIAL at a throw-away price of Rs3.25 lakh per acre against the market price of Rs100 crore per acre.
 
The petition sought quashing of the government's decision on land allotment to private airport operator.
 
"This petition seeks a thorough probe in this matter by the CBI and criminal proceedings against the guilty. This decision has caused substantial revenue loss to the government and corresponding gain to the private parties," said the plea.
 
"The private partners in DIAL have made just Rs 1,813 crore of investment out of total investment of Rs 12,857 crore for Delhi airport project. By just investing Rs 1,813 crore, GMR now owns 4,700 acre of land in the most prime location of India. State largesse has been passed into the private hands virtually free," the petition added.
 
The NGO's counsel had earlier argued that "the CAG report, which was submitted to government on May 11, 2012, has listed out a number of glaring examples of favouritism to DIAL causing huge losses to the exchequer." 
 
He had also argued that the NGO had sent a complaint to the Prime Minister and also to the CBI on August 22, 2012 on irregularities in land allotment, but they have not responded.
 
The PIL has also sought the court to monitor the probe to be done by the CBI, alleging that the former civil aviation minister was involved in the decision-making process.
 
Claiming the decision as "illegal," the NGO also sought the court's order to "revoke" the transfer of the 190 acre of land allotted to DIAL.

Kejriwal targets RIL; alleges Mukesh Ambani received undue favours from Congress, BJP

Arvind Kejriwal alleged that RIL has been receiving undue favours from the government—both the NDA and UPA—and Mukesh Ambani is using pressure tactics to appoint the petroleum minister

 
Social activist Arvind Kejriwal has alleged that Mukesh Ambani-owned Reliance Industries (RIL) has received huge benefits in last one decade despite flagrant violations of various agreements. Kejriwal also alleged that two ministers were shifted from the petroleum ministry to provide benefits to RIL.
 
He said, “Huge benefits were given to RIL in last one decade despite flagrant violations of various agreements and these benefits to RIL are causing serious price rise in the country.” 
 
Alleging both BJP and Congress’ involvement in it, Kejriwal said, “BJP signed a sweet deal with RIL in 2000 and Congress faithfully implemented it.”  
 
“If RIL’s demand of increasing the gas price to $14.2 per mmBtu (million metric British thermal unit) is accepted, it would lead to shut down of several gas-based power plants and increase in power and fertilizer prices. However, it would result in Rs43,000 crore of additional benefits to RIL,” Kejriwal said.
 
Kejriwal said, “In 2006, Mani Shankar Iyer was removed and Murli Deora brought in to increase RIL capex to $8.8 billion from $2.39 billion and to increase gas price to $4.2 per mmBtu from $2.34 per mmBtu. Similarly, in 2012, Jaipal Reddy has been removed and Moily brought in to increase gas prices to $14.2 mmBtu from $4.2 per mmBtu and to condone RIL’s blackmailing of reducing gas production.”
 
“When RIL failed to meet its production targets, Jaipal Reddy decided to disallow its capital expenditure. In the first instance, a notice for disallowance of $1 billion expenditure was sent to RIL. This would mean a loss of $2.2 billion (Rs11,000 crore) to RIL, if we consider investment multiple (IM) ratio. Next year, this disallowance could be $1.5 billion, which would mean a loss of $3.3 billion (Rs16,500 crore) for RIL. That is the reason why Mukesh Ambani got restless. And that is the reason why Jaipal Reddy was transferred out,” Kejriwal alleged.
 
Kejriwal and his team demanded that RIL should immediately stop its blackmailing and the Krishna Godavari (KG) basin contracts given to RIL should be cancelled. He also asked the government to immediately put in place adequate system to get full production from KG basin at cheapest prices for the country.

Mr Nilesh Karmekar: Thanks for raising this question.

Government has to call the bluff of RIL and find out, by a third, independent qualified investigator whether the claims made by Reliance are genuine or not; the legal department need to check and find out if RIL claims are admissible and if there is a force maejure condition that would invoke a renegotiation of the contract.

We need to find out if there is a compromise solution to this sudden impasse that has developed or not. Simply delaying to make a decision is not helpful to anyone.

If the government were to look at the imperative need to increase oil/gas output to reduce our international dependence, than, they would not be dilly-dallying on Cairn India's request to go ahead with their expansion plans. The reason I am raising this issue of Cairns is simply to show that the crux of the matter is to increase our national production; if Reliance are intentionally delaying the supplies or chocking up the gushing oil or gas, there are legal remedies left to Government to use against them.

We must remember that civil servants also cannot take "egoistic" stands, nor, can public accuse the prime minister or the party in power showing undue favours to a company, just because they are the largest indian enterprise.

Let's come off this stand and work towards improving the conditions in the country.

Let's be self-reliant, and not,
necesarily, "reliance" in such matters, and deal with it dispassionately.

Mr Mukesh Ambani is a contractor appointed by Government. Since Government money was involved CAG had scrutinised expenses incurred by RIL in KGB. On the same lines performance audit of RIL along with that of government is mandatory. RIL seem to hide facts as Mr Ambani is resisting the same.

Let's forget that Reliance is an Indian company. Let's say, it is a foreign company called Exxon or Total and they had won the international bid and got the contract to explore, and let us say they struck oil at KG
as Reliance has done.

Then would we all debate like we are doing today? No; rather, we would shout and seek that the oil biz be nationalized and taken over by the government and run it themselves.

Fine. So far so good. What has government owned companies do? ONGC for instance? Except for Bombay High, what is the progress, if any, they have made?

Also, let us say that Exxon or Total din't find one ounze of oil or gas. What would have happened?

We would have to import both from international market at current prices, if we need these two products. Right?

We all are getting excited about the parties involved and not the spirit of the contract. If the contract is the basis of biz, let's simply
go by the terms of that contract. Period.

if it is a foriegn company our govt would have gone out of way to protect the interest of that foriegn company by taking the burdon on our public sector undertakings as in the case dhabol project. same type of arguments are being given now for fdi in retail. the dhabol project was given just to bail out enro0n. everything possible was done to scuttle the india s legittimate claims the officer who tried to enforce the indian right was unceremoniously relived so that enron will be safely bailed out. same thing is being planned now for bailing out foriegn retailers. in the name of reforms.

Lets take spirit of contract:1.Price fixed till 2014. Why RIL seeking change? Even if meantime mkt price has gone up, RIL took a business risk in agreeing to fixed price till 2014. They must live by it. Instead they are blackmailing Govt. by not producing gas. RIL believes in self interest over national interest or even contractual compliance!2.Contract provides for sharing of revenue with Govt. and all Govt. receipts are subject to Govt audit/scrutiny, be it contractual or through taxes. So why is RIL objecting to audit? Surely they have things to hide! 3.There is fear of RIL in Govt. Otherwise why is the Govt. not giving notice of termination of contract when there is so much breach of terms of contract?Very few hands in the Govt. are clean and RIL knows this and is taking liberties, virtually dictating to Govt. Lastly if RIL is more efficient than PSU ONGC, why are they not producing the gas lying underground ,for sure, instead of giving excuses?

IT IS THE SHORT SIGHTEDNESS OF CONGRESS GOVT THAT LED TO THIS SITUATION. it wanted to favour mukesh ambani at the cost of anil ambani who is from samajvadi party. they even sacrificed the interest of ntpc just to make life of anil ambani miserable.becasue the agreement was that anilambani groupe will get gas at the rate at which ntpc gets the gas. that rate was $2.75. they twisted the matter to dicide the who is owner of gas. by this they blocked the entry of foriegn companies in exploration. all subsiquent auctions did not receive foriegn particiapation. kejriwal has ignored this loss to the country.but in his enthusiasom to paint both cong and bjp in same colour he forgot that reliance was awarded the field in international tender. firsst fight the more evil then take on the lesser evil. and he may not need to fight the lesser evil because they may change their attitude seeing the fate of the greater evil.

Both sets of politicians of NDA-UPA variety really consider the people to be blind, deaf and dumb. They still need the proof to prove that they are corrupt and they are happily looting the country as a joint venture. Shame on them.

The corrupt regime has become incorrigible and has no cure other than direct action- overthrow of such regimes by the people. Well done Arvind, Keep it up.

A lot of mud he is flinging will stick, provided his exposes are further investigated by those who have the power and courage to do so.But Reliance group has become too big to fail and various interested and vested groups will ensure that nothing happens to them.Reliance after all are past masters at this game and Kejriwal is a novice!Every new, prized, expose~ only pushes the earlier one to the back-burner.Robert Vadra is almost forgotten after Gadkari and now Reliance!!

If Mr Kejriwal is correct in this allegations then Reliance should debar from this contract and it is very much harmful to Country. This should be Audited by CAG or Lokpal( which is not at present). And both Brothers shouldn't allowed to do any business in Country.

LPG consumers can now fill up KYC form till 15th November

Consumers in the KYC form have to gives all the necessary details like name, date of birth, father's name, mother's name, spouse name, complete address with pin-code and also an optional information about bank details

 
New Delhi: The government has extended by 15 days the deadline for filling the know your customer (KYC) form by LPG consumers to 15th November, reports PTI.
 
In a nationwide exercise to weed out multiple or ghost connections, the state-owned oil companies had previously asked their domestic cooking gas (LPG) distributors to collect and verify duly filled KYC forms from the consumers by 31st October.
 
"We have now decided to extend the deadline by 15 days to 15th November," a senior Oil Ministry official said here.
 
The drive to weed out multiple connections at same address follow last month's government decision to cap supply of subsidised LPG to six cylinders per household in a year.
 
The official said oil companies are implementing the policy of 'one household, one connection' and have asked consumers to voluntarily give up additional connections.
 
Multiple LPG connections in the 'same name and at the same address' as well as 'husband and wife' owning connections at the same address would be summarily disconnected.
 
In case of multiple connections at same address under different names, distributors have been asked to collect KYC forms to verify genuine users.
 
Consumers in the KYC form have to gives all the necessary details like name, date of birth, father's name, mother's name, spouse name, complete address with pin-code and also an optional information about bank details. They have to submit self-attested photocopies of address and ID proof along with the filled in form.
 
The official said transfer of LPG connection to family members during lifetime would be permitted, subject to certain conditions.
 
Also, transfer of LPG connections to legal heir in case of death of consumers would henceforth be done through a self-declaration by the next of kin and death certificate.
 
Previously, legal heir/succession certificate was required.
 
"All LPG consumers are eligible for three subsidised domestic cylinders during the remaining part of the current year ending 31 March 2013," the official said. 
 
New subsidised LPG connections will be issued after completion of the KYC formalities and multiple connection check.
 
There is no restriction on the number of domestic non-subsidised cylinders that consumers can avail beyond the three subsidised LPG refills to meet their genuine demand.
 
From 1st April, next year, LPG consumers can avail six domestic subsidised LPG refill cylinders in a financial year.
 
There will be no restriction on the number of domestic non-subsidised cylinders that consumers can avail, beyond the six subsidised cylinders to meet their genuine demand.
